1. Acceptance of Terms

By accessing or using Mars Agent's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our services.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Mars Agent provides a platform for building applications through AI-powered component assembly. Our services include:

  • AI-assisted application development tools
  • Pre-built, tested, and secure component library
  • Workflow automation and integration capabilities
  • Hosting and deployment infrastructure
  • Analytics and monitoring dashboards
  • Technical support and documentation

We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice to users.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or use
  • Ensuring your contact information is accurate and current
  • Complying with all applicable laws and regulations

You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without authorization.

4. Subscription and Payments

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis, depending on the plan you select.

  • Subscription fees are non-refundable except as required by law
  • We may change subscription fees with 30 days' notice
  • Continued use after fee changes constitutes acceptance
  • You authorize us to charge your payment method automatically
  • Failure to pay may result in suspension or termination

Free Trial

We may offer a free trial period. At the end of the trial, you will be automatically enrolled in a paid subscription unless you cancel before the trial expires.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any laws, regulations, or third-party rights
  • Transmit any malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Engage in any form of automated data collection without permission
  • Impersonate any person or entity
  • Use the Service for any illegal or unauthorized purpose
  • Harass, abuse, or harm another person
  • Send spam or unsolicited communications
  • Infringe on intellectual property rights

We reserve the right to terminate or suspend access immediately, without prior notice, for any violation of these terms.

6. Intellectual Property

Our Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Mars Agent and its licensors. The Service is protected by copyright, trademark, and other laws.

Your Content

You retain ownership of the applications, workflows, and content you create using our platform. By using the Service, you grant us a limited license to:

  • Host, store, and display your content
  • Provide the Service to you
  • Create backups and archives
  • Improve our services (using aggregated, anonymized data)

7. Service Level Agreement

We strive to maintain high availability of our services:

  • Target uptime of 99.9% for production services
  • Scheduled maintenance windows with advance notice
  • Status page for real-time service health updates
  • Support response times based on subscription tier

Service credits may be available for downtime exceeding our SLA commitments, subject to the terms of your subscription plan.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

You are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including GDPR, CCPA, and other regional regulations.

9. Third-Party Services

The Service may contain links to or integrate with third-party services. We are not responsible for:

  • The content, privacy policies, or practices of third parties
  • Any damage or loss caused by third-party services
  • The availability or accuracy of third-party services

Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of results
  • Uninterrupted or error-free service

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARS AGENT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Cost of substitute services
  • Any damages exceeding the fees paid in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Mars Agent and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Non-payment of fees
  • Requests by law enforcement
  • Extended periods of inactivity
  • Discontinuation of the Service

Upon termination, your right to use the Service will cease immediately. You may export your data within 30 days of termination, after which it may be deleted.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of San Francisco County, California.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Continued use of the Service after changes constitutes acceptance of the new Terms.
